Uncontested divorce (divorce by agreement)

Without children - if you both agree to the divorce, you have agreed on property settlement, housing and alimony after the divorce, the price can range from CZK 5,000.

• Draft of a proposal for divorce from CZK 2,000.

• Draft of the property settlement agreement from CZK 3,000.

Should you need further consultation or legal representation at the court, we charge an hourly rate of CZK 2,200. The court can decide on the divorce at the first hearing. The duration of an uncontested divorce from the start of the proceedings varies between 3 – 5 months, depending on the speed of the relevant court.

With children - if you both agree to the divorce, you have agreed on the children custody and maintenance, property settlement, housing and alimony after the divorce, the price can range from CZK 10,000. 

• Draft of a proposal for divorce from CZK 2,000.

• Draft of the property settlement agreement from CZK 3,000.

• Draft of the agreement on the children custody and maintenance from CZK 3,000.

• Draft of the proposal to the court for the approval of the agreement on the children custody and maintenance from 2,000 CZK.

The duration of the entire process can vary between 5-12 months or more. The divorce court will not dissolve the marriage until it is presented with a final judgment approving the agreement on the children custody and maintenance. If you need further consultation or legal representation at the court, we charge an hourly rate of CZK 2,200.

 

 

Disputed divorce - if you cannot agree on the above, the final judgment will usually be preceded by several hearings where the court examines the causes of the breakdown of the marriage. Should the court proceeding regarding the children custody take place, the divorce may last for several years. The price for legal services will then depend on how many court hearings will be ordered, if the court will order the preparation of expert opinions, if you take a lawyer or you handle everything on your own, etc. You can spend 50,000 CZK or 100,000 CZK for a contested divorce.
